Figure 4. 1 shows proportion of promotional tools in b2c and b2b market. It’s evident, that advertising is on the first place in promoting consumer goods. Producers of these goods try to cover mass audience and advertising is an optimum variant. Almost all the population is in touch with media, including TV, radio and newspapers, or can see billboards or advertising placards, so the information about product or service can easily achieve them. Of course, here comes the question why personal selling is not so popular here. First of all, it’s because of narrow cover. Personal selling is aimed to each customer, so it’s impossible to communicate with everybody. And secondly, the proportion between price and result makes this tool irrational: vast sums of money will be spent out, but the there will be no confidence in sales increasing. On the other hand is industrial or b2b market, where personal selling is on the top. And this result is understandable. The target audience here is not the man in the street, but representative of business, the professional, so it’s better to use personal approach. And advertising campaigns are not so effective here: advertising reaches a mass audience, personal or direct selling focuses on one customer at a time. Besides, industrial products and services are more sophisticated and require detailed explanation, customized application, or careful negotiation over price and payment plan. The salesperson helps the customer identify problems, works out a variety of solutions, assists the buyer in making decisions, and provides arrangements for long-term service. Does advertising do the same? Unfortunately, doesn’t. And in b2b market all of the enumerated points are key to the success in business. If we continue examination of promotional instruments, we will see that usage of other tools is the same. Both b2b and b2c use sales promotion in order to increase sales volume, as an addition to personal selling and advertising. And also public relations are on the lowest position as the most unpopular tool. This can be explained by the result of PR: it builds image, reputation, not sales. Very few companies use this form of promoting, because most of them put profit on the first place, and the image of the company on the second. Only after several years of stable position in the market they turn to PR. So, to make a conclusion, I want to say that it’s important to remember that choosing promotional tool depends on the market, where you do business. Businessmen should take it into consideration, if they don’t want to flow out their money without worthy result.

Rules of Interpretation

A  statute  is a formal written enactment of a  legislative  authority that governs a  state,  city, or  county. Typically, statutes command or prohibit something, or declare policy. Statutory interpretation  is the process by which courts interpret and apply  legislation. Some amount of interpretation is always necessary when a case involves a  statute. Sometimes the words of a statute have a plain and straightforward meaning. But in many cases, there is some  ambiguity  or vagueness  in the words of the statute that must be resolved by the judge.To find the meanings of statutes, judges use various tools and methods of statutory interpretation, including rules of interpretation. The five (5) main rules of statutory interpretation are: 1. The Context Rule When the context rule is used to interpret an act it is understood with reference to the words which are in immediate connection to it. This can be expressed by the Latin maximum â€Å"noscitur a sociisâ⠂¬  which means â€Å"a word may be known by the company it keeps† when translated.The context rule is a more accurate way of interpreting a statute because in each rule we tend to find out the meaning of a statute by learning about the context in which it was written. When a word stand alone it may have one specific definition however when one word is used in more than one context it may have a variety of different meanings. When using the context rule one should consult the definition section of the statute and the Interpretation Act. 2.Interpretation in the Light of Policy ( The Fringe Meaning) Courts often announce that that they are trying to discover the intention of the legislature when interpreting statutes. If the courts find it difficult to decide whether a particular situation falls within a statute or not, the situation was probably unforeseen by the legislature. In this case the members of parliament would be just as confused as the judges. When statutes are con structed the maker of the document may not mean to include that which the court is concerned to ascertain, but they have said. . The Mischief Rule When the mischief rule is applied the act or document is to be constructed to suppress mischief and advance the remedy. In applying the rule, the court is essentially asking what was the â€Å"mischief† that the previous law did not cover? The Mischief Rule is of narrower application than the  golden rule  or the  literal  rule in the sense that it can only be used to interpret a statute and only when the statute was passed to remedy a defect in the common law.The way in which the mischief rule can produce more sensible outcomes than those that would result if the literal rule were applied is illustrated by the ruling in  Smith v Hughes  (1960). It was a crime for prostitutes to â€Å"loiter or solicit in the street for the purposes of prostitution†. The defendants were calling to men in the street from balconies and tapping on windows. They claimed they were not guilty as they were not in the â€Å"street. † The judge applied the mischief rule to come to the conclusion that they were guilty as the intention of the Act was to cover the mischief of harassment from prostitutes. . The Literal Rule Literal rule states that if the words in an act are precise and unambiguous then they should be used in their natural and ordinary sense. The court can not extend the statute to a case outside of its terms bit with its purpose. Neither can it leave out the case that the statutes literally include thought it should not. If any doubt arises then the circumstances behind the enactment of the act are taken into consideration. Thus if the words are clear in themselves then they are to be put into effect. 5.The Golden Rule In golden rule, the meaning of the words are modified in order to avoid repugnance, inconsistency or absurdity. This rule applies in a few cases. In the first case the rule allows the court to prefer a sensible meaning, which would be the most obvious, to an absurd one even though both are possible. In another case this rule will only be used if the words are absolutely incapable of coinciding with the obvious intention of the statute. It is only where the words will avoid an unreasonable result that they must prevail.

While in the act of chasing, Officer Nelson heard a fight and he located it. From a brick- walled backyard, he saw two teenagers fighting. He entered through the open gate and pacified the two. He also noticed baggies in the patio table few yards away. He called the parents of the boys and they went in the patio table. He noticed it to be drugs and eventually arrested the woman who was explaining about the baggies. On the other hand, Officer Mahoney pursued on the dropped purse. As he retrieved the stolen purse, he noticed marijuana cigarettes, among others, spilled from the purse. He then arrested the woman and took the contents of the purse as evidence against the woman. In the general practice, police officers are mandated to obtain a valid search warrant before they can search for items or goods in a place of the suspect. Absence of a search warrant would make the evidences obtained inadmissible when presented in court. The consequence would be wastage in effort and losing the case. There are three elements before police officer can claim it as an exemption under the plain view doctrine. First, it is required that the officer must lawfully present in the place protected by the 14th Amendment (PoliceLink. com, 2008). Second, the items must be out in plain view (PoliceLink. com, 2008). Third, the officer must immediately recognize the item as evidence or contraband without making a further intrusion (PoliceLink. com, 2008). In the present case, Officer Mahoney was lawfully in a place where the marijuana was seized. This is so because they were in legal discharge of their authority as police officers in chasing criminals. The second element is also present as the marijuana was spilled from the purse and is in the plain view of the officer. The woman cannot further state that the marijuana was seized from the purse as the item was found outside the purse together with her lipstick, compact, lighter, etc. Likewise, the last element is present because Officer Mahoney immediately recognized the item as marijuana in which possession of such is punishable by law. Thus, the marijuana can be used as evidence against the owner of the purse even it was taken without a search warrant. In the case where Officer Nelson seized the drugs, the doctrine of open fields applies. Doctrine of Open Fields is another exemption from the general requirement of search warrant, probable cause, or even legal justification (Ferdico, 2004, p. 477). In this doctrine, the police officer was in the place because of a lawful discharge of his duty as peace officer. While in the place, Officer Nelson saw baggies which he immediately doubted to be an illegal drug. This would fall under the doctrine of open fields even if the woman would contend that the police officer trespassed. In the doctrine of open fields, the trespassing cannot render the evidence inadmissible as the Supreme Court concluded in Oliver v. United States (466 U. S. 170). In the said case, the Supreme Court convicted the man who was manufacturing an illegal substance based on the discovered plantation of marijuana located miles away from his home (466 U. S. 170). The court held that even the property was private, the man does not have legitimate expectation of privacy and trespassing is not even enough to invalidate the evidences (466 U. S. 170). Thus, the woman can be held liable for illegal possession of drugs based on the seized evidences under the â€Å"open fields doctrine†. In the two instances, the more applicable is the open view doctrine. This is because the three elements are present in both instances. In the case of the seizure of marijuana, the place being public does not affect the doctrine while in seizure of illegal drugs; the police officer was already in a place for legal reason, which is to pacify the fighting boys. The second element is also satisfied because the items were in plain view. The marijuana was outside the purse which had been spilled out when the purse was dropped. The illegal drug was also in plain view because the officer noticed it when he was a few steps away from the table when the baggies were placed. With regard to third element, both police officers immediately recognized the items as marijuana and illegal drug even without further intrusion of the place. Growing up in Germany I’ve been living in America for one and a half year and I honestly have to say that I got used to the culture, values and traditions pretty quickly. But one thing I never understood and I’m still doubting about is why Americans get married with an age of 21 or even younger. In European countries and many other ones like China and Japan the average age of marriage is 30. There is a world out there, new things to experience and people to meet – so why settle down so early? All of the American couple friends I made dated in High School and got married after College. They have been together for a couple of years and seem very happy with what they have in each other. They know each other well, enjoy their comfort in consistency and have history together. I personally doubt if they are just staying together because they are afraid of the unknown or do they think they’ll never find somebody better? In my opinion you haven’t really experienced life when you go and settle down with somebody you met in High School. In the High School age you are still trying to figure out who you are in life, develop characteristics and are very influential of others. So is it a good idea to decide who you are gonna spend the rest of your life with in a stage of age you are still trying to find yourself? The twenties are dedicated to just you. You go out and travel, explore what you ever dreamt of and live your own life. Of course it is always challenging to be single and go on dates. No doubt about that! But being single and not â€Å"tied down† offer you experiences which enlarge your personal horizon immense. The kinds of different people you meet and experiences you’ll have, if bad or good, will help you figure out who you are and what you want in life and certainly in a relationship. The biggest fear I had if I were married with 21 is what happens if you get divorced. You don’t know a life without the person you met as a teenager and probably can’t imagine anything like that. My personal conviction of not getting married at an early age doesn’t result of that, but it’s definitely scary to devote yourself to somebody in an age where you haven’t explored yourself. I’m personally convinced that I’ll find the right person to marry after intensely living my twenties. And that doesn’t mean that I just want to sleep around 😉 I hope by that time I’ll definitely know what to expect from my partner and be mature enough to decide who is the right one for me. The intention of my opinion is definitely not to disrepect anybody’s lifestyle or marriage. If two people love each other and get married it is one of the most beautiful things! I personally doubt that it is a good decision to get married in an early age, but this is up to everybody themselves of course.

In the global competition and companies pictures, it is of great importance for a company to come up with a strategy that will evaluate its competitive advantage. In this case, PESTEL analysis is used by the Tesco plc. This analysis indicates that, Tesco plc has to monitor and respond to uncontrollable forces that are posed by six factors. These factors include; political, economic, socio-cultural, technological, environmental, and legal. In this essence, these forces influence the macro environm ent of the Tesco plc. Tesco plc was founded in the year 1919 by Jack Cohen and the first store was opened in the year 1929 in Burnt Oak. Tesco plc has a flat hierarchical structure where each and every intended action has to pass through the management. There are six levels which are between checkout staff and chief executive. This company has employed more than 326000 employees across the globe where 237000 of them are in Europe where it has its largest private employer. (Exploring Africa) African stereotypes- A Reaction from the Public After generally refraining from criticizing media coverage of African news, it has becoming increasingly hard for some people to resist commentary. I suppose one can only read and watch so many stereotyped and misinformed news stories before it becomes too much to bear. Texas in Africa (an African blog spot), the ladies at Wronging Rights, among others have always been quick to stress the problem with bad reporting. For example: A story written by Jeffrey Gettleman on the drought currently plaguing Kenya. Gettleman writes: A devastating drought is sweeping across Kenya, killing livestock, crops and children. It is stirring up tensions in the ramshackle slums where the water taps have run dry, and spawning ethnic conflict in the hinterland as pastoralist communities fight over the last remaining pieces of fertile grazing land. The twin hearts of Kenyas economy, agriculture and tourism, are especially imperiled. The fabled game animals that safari-goers fly thousands of miles to see ar e keeling over from hunger and the picturesque savannah is now littered with an unusually large number of sun-bleached bones. (Gettleman, 2009) There is definitely a severe drought in Kenya and it is indubitably a cause of great concern for Kenyans dependent on agriculture for their livelihood. As Gettleman notes, the drought is also increasing conflict in some parts of the country, with farmers struggling for access to arable land. Aside from this point, what I find most troublesome about Gettlemans piece is his suggestion that the Kenyan economy will somehow crumble as a consequence of the drought. The unknowing reader comes away from Gettlemans piece with an image of a completely impoverished, desert-like country on the brink of disaster a stereotype of a typical African country. While Kenya surely does have its problems Gettlemans imagery is highly misguiding. Technology in Kenya is expanding at a rapid pace, heralding much opportunity for development. Emphasis is also being placed on the countrys private sector as an engine for growth, as well as small-scale manufacturing. One doesnt get any of this from Gettlemans piece. African stereotypes and Social Psychology Research by social psychologists strongly indicates that we as individuals find it difficult to hold conflicting or contradictory beliefs/understandings. Social psychologists call this aversion cognitive dissonance, the discomfort in holding contradictory beliefs or representations. Yet when we are exposed to evidence that contradicts an accepted image, we may not recognize or be bothered by the contradiction (e.g. Africans are primitive but not be flustered when introduced to Africans who are clearly very modern), unless prior representation is challenged. To give a simple example, many Americans believe that Africa is comprised of jungle, sparsely populated savannah, or desert. When shown pictures of modern African cities, individuals may accept that the cities are in Africa; however, if the dominant representation is not directly challenged in attempt to maintain cognitive consonance, students will maintain their prior perception. So in spite of pictorial evidence, many people wil l revert to their prior knowledge and understanding of Africa. Debunking African stereotypes It is important that educators advocate a feeling of understanding and appreciating other cultures and societies. So many people tend to judge other peoples actions and ways of life by their own cultural values. Educators need to steer away from this ethnocentric view. In teaching about Africa, stereotypes and biases naturally creep in. educators should be on guard to not perpetuate the beliefs that seem to come to mind. Fetal Brain Tissue Transplantation in Parkinson's Disease Patients Parkinson's disease is a neurological disorder characterized initially by muscular rigidity and slowing of voluntary movements (1). Ultimately, the characteristics are tremor, mask-like faces, decreased spontaneous blinking, flexion posture and sometimes cognitive impairment. The neuropathology of Parkinson's disease generally involves loss of cell bodies in all melanin-containing brain regions and invariably a loss of substantia nigra dopamine-containing neurons (DA). The principal target for dopaminergic neurons located in the substantia nigra is the striatum and the loss of dopaminergic tone in the striatum is thought to produce most of the symptoms of Parkinson's disease. Since Parkinson's disease is a dopamine deficiency, treatment with L-Dopa, the precursor of dopamine, was successful in treating Parkinson's patients (1). However, these patients taking L-Dopa often develop side effects and in about 50% of the patients, the drug effectiveness is lost. As an alternative to drug therapy, the possibility of grafting dopamine-containing tissue into the brains was proposed. From the proposal, there have been a vast amount of experiments to test transplantation effectiveness. Work in amphibians and fish were the first to demonstrate the possibilities for neuronal replacement after damage in the central nervous system (2). This film thus focuses on the struggles that the male protagonist faces in trying to compete with the popularity of women's sports and his desire to take part in the world of women's sports. Women in this film are portrayed as strong characters who are highly capable of doing what they do -- being professional basketball players. Their struggles lay in their dealing with fame and all the complications that it entails. These include rumors of financial problems, affairs, and infighting among teammates. The female protagonist is a character who can "do it all." She has a family, including two young children and a husband. She was raised in a proper household, but held on to her dreams of playing basketball for a living. The beginning of the film shows her struggles as a child in fighting against stereotypes, being taken less seriously than the boys, and being discouraged from playing sports. However, as she reaches high school and beyond, the sky is the limit. Her opportunities increase as women's sports in the general society are given greater emphasis and professional leagues are established for all sports that had an equivalent male league. The women's leagues' visibili ty and popularity rise among fans who become disillusioned with all the infighting that had been occurring in the male leagues. Soon, the financially disadvantaged male leagues decide to challenge the women's leagues to compete against each other. This is where the major climax of the film occurs. The male protagonist had been involved in a financial scheme within the male basketball league which ended in the murder of a major basketball star. He ends up broke, without friends, and with no possibility of playing professional basketball, especially in light of the financial distress that the league was experiencing. He knows of the success that the women's teams had been recently having and approaches the manager of his ex-team with a plan for reviving the popularity and financial wellbeing of the male league.

Toni Morrison shows that through the relationship between Hagar and Milkman, while Shakespeare uses the innocent Ophelia, who is deeply in love with Hamlet. In the book Song of Solomon and the play Hamlet, Tony Morrison and Shakespeare respectively, portray the kind of love that eventually leads to madness. The love between Ophelia and Hamlet, as well as between Hagar and Milkman is from the beginning pure love. The letter, which Hamlet writes to Ophelia, shows that he really loves her: â€Å"the most beautified Ophelia† (II, iii). He used the word beautified to display a sincere tribute and it is obvious that he loves her. In Song of Solomon, feeling starts to arise between Milkman and Hagar very early.
